For those of you who are following this case, the Chief’s attorney has filed a motion to dismiss. If you’re not familiar with the case, you can read my first article here. I’m familiar with this attorney. He’s a good attorney. His motion revolves around the two portions of the Ohio Revised Code I talk about in the last half of my first article – 9.69 and 2923.1214.
The motion and court statement are shown below. The first 6 pages or so are not as interesting as the last half of the motion – starting halfway down on page 7 at “III. The Indictment is Defective”.
